1. Acceptance of these terms

These Terms of Use govern your use of higheredchange.com (the “site”), operated by Higher Ed Change LLC (“Higher Ed Change,” “we,” “us”). By using the site, you agree to these terms. If you don’t agree, please don’t use the site.

2. Using the site

You may use the site for lawful purposes, for your own information and for planning at your institution. You agree not to:

  • use the site in a way that breaks any law or infringes anyone’s rights;
  • try to gain unauthorized access to the site, its systems or data;
  • interfere with the site’s operation, including by introducing malicious code or overloading it;
  • scrape, copy or republish substantial parts of the site without our permission;
  • submit false information or impersonate anyone.

3. The AI Readiness Benchmark and other content

The AI Readiness Benchmark is a short self-assessment. Your score reflects the answers you give and is intended as a starting point for discussion. It is not an audit, accreditation finding or formal evaluation of your institution.

Content on the site, including articles, examples and illustrative dashboards, is general information. It is not legal, compliance, financial or other professional advice for your specific situation. Sample data shown on the site is illustrative.

4. Consulting and Higher Ed OS

Describing a service on the site is not an offer to provide it. Consulting engagements, Higher Ed OS pilots and any related software or data processing are provided only under a separate written agreement, which governs if it conflicts with these terms.

5. Intellectual property

The site and its content, including text, graphics, the Higher Ed Change name and logo, Higher Ed OS, frameworks and the benchmark, are owned by or licensed to Higher Ed Change and protected by intellectual property laws. You may view and print pages and share links for non-commercial use within your institution. Any other use requires our written permission.

6. Information you send us

You are responsible for the information you submit through the site. Please don’t submit student education records, other people’s personal information without permission, or anything confidential you don’t want us to have. Our Privacy Policy explains how we handle personal information.

7. Third-party links and tools

The site may link to or use third-party websites, platforms and tools, including scheduling and form tools. We aren’t responsible for their content, policies or practices.

8. Disclaimers

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that the site will be uninterrupted, error-free or free of harmful components, or that any particular result will follow from using its content or tools.

9. Limitation of liability

To the fullest extent permitted by law, Higher Ed Change will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of the site. Our total liability for any claim relating to the site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

10. Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute relating to the site will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction.
